These Terms of Use (“Terms”) govern your use of phonemine.org, the Phonemine member portal and mobile app, and the Phonemine kiosk network (together, the “Service”), operated by Bit Clean Technology LLC (“Bit Clean,” “we,” “us”). By using the Service — including by depositing a device in a kiosk — you agree to these Terms.
1. What the Service is
Phonemine is a trackable IoT phone-recycling network. Residents drop off retired phones and program-scoped accessories at kiosks for free; we collect, process, and route every device through a documented, R2-aligned workflow — reuse where possible, responsible recycling or material recovery otherwise. Collections are tracked and auditable by batch, from kiosk to certified downstream partner.
2. Depositing a device
By placing an item in a kiosk you confirm that:
- You own the item or have the right to dispose of it;
- You are donating it permanently and unconditionally — title transfers to Bit Clean on deposit, deposits cannot be retrieved, and no payment is owed to you for the item;
- The item is in scope: cellphones, and program-scoped accessories such as chargers, cables, and device batteries. Do not deposit anything else — no liquids, no loose or damaged lithium batteries showing swelling or leakage, no hazardous materials, and nothing that isn’t electronics.
Back up and remove your data first. Before depositing, you should back up anything you need, sign out of accounts (e.g., Find My / Google account), and factory-reset the device if you can. While we sanitize every device we can to the NIST 800-88 standard and route the rest to certified physical destruction, the deposit is irreversible — once a device is in the kiosk, we cannot return it or recover anything from it for you.
3. Our handling commitment
Every deposited device follows a documented process: devices that support software sanitization are wiped to NIST 800-88; devices that cannot be wiped (locked, damaged, or end-of-life) are routed to certified recycling or physical destruction through R2-aligned downstream partners. We do not access or attempt to recover the contents of deposited devices. Each collection batch carries chain-of-custody documentation from kiosk to final disposition. Published impact figures use verified, measured data only.
4. Member accounts
Portal registration is optional and free for residents. Some account types (Host-Operator, Site, and downstream partner accounts) require an application and our approval, and operate under separate partner terms. You are responsible for your account credentials and for the accuracy of information you submit. We may suspend or close accounts that violate these Terms, abuse the Service, or attempt to manipulate program metrics.
5. Community programs and published data
Leaderboards, Community Mining Awards, and the public dashboard use community-level aggregates of verified kiosk measurements. Rankings are based solely on published, objective methodology and have no relationship to any fees paid by hosts. We may correct published figures if reconciliation finds an error, and we’ll do so transparently.
6. Acceptable use
You agree not to: misuse, damage, tamper with, or attempt to open kiosks; deposit out-of-scope or hazardous items; attempt to retrieve deposits; interfere with sensors or data collection; probe, overload, or attempt to bypass security of the website, portal, app, or APIs; scrape personal data; or use the Service for anything unlawful. We may pursue costs caused by tampering, contamination, or hazardous deposits.
7. Hosting a kiosk
Kiosk hosting is governed by a separate hosting agreement between Bit Clean and the host institution. These Terms apply to hosts’ use of the website, portal, and app.
8. Intellectual property
The Service, including the Phonemine name, “Mine Phone, Phone Mine,” our logos, software, and content, is owned by Bit Clean Technology LLC or its licensors. We grant you a personal, non-exclusive, revocable license to use the website, portal, and app as intended. Don’t copy, modify, reverse-engineer, or redistribute the Service except as the law allows.
9. Disclaimers
The Service is provided “as is” and “as available.” Live dashboards and statistics are provided for information; while we work to keep them accurate, real-time figures may be provisional until reconciled. To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of liability
To the fullest extent permitted by law, Bit Clean’s total liability arising out of or relating to the Service will not exceed one hundred U.S. dollars (US $100), and we will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of data on deposited devices — which is why Section 2 asks you to back up and reset before depositing. Nothing in these Terms limits liability that cannot be limited by law.
11. Indemnity
You agree to indemnify Bit Clean against claims arising from your violation of these Terms, including deposits of out-of-scope or hazardous items and kiosk tampering.
12. Governing law
These Terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-law rules. Courts located in Denver County, Colorado have exclusive jurisdiction, and you consent to venue there. If any provision is unenforceable, the rest remains in effect.
13. Changes
We may update these Terms; the current version is always posted here with its effective date. Continued use after changes means you accept them. Material changes affecting portal members will be announced in the portal or by email.
